Confidential Divorce

The mediation process is confidential and each party involved in a mediation proceeding has a privilege to refuse to disclose, and to prevent any person present at the proceeding from disclosing communications made during the proceedings. Of course the executed Mediated Settlement Agreement will be ultimately filed with the Court and will be revealed unless otherwise agreed to by the parties. In this way the parties can be encouraged to verbalize what is troubling them or make offers or concessions they may not want someone else or a judge to hear if an aspect of the divorce proceeds to litigation. Be mindful that there are certain exceptions to the non disclosure of information such as the discovery of abuse, neglect, or abandonment of a child or abuse of a vulnerable adult, or the planning of a crime to name the most prominent.
